Please..request that only those with personal experience with this respond. I have to decide in the next hour or so and have lawyer opinions already.
Has anyone gone through this?
My H1 is pending 221g admin process (Pink. possibly because I have a Phd in biology) I can't wait much longer as I may risk losing my job. Can I travel on my valid AP? I am not concerned about keeping my H1 status etc. My only concern is at port of entry. Lawyers have told me it is ok, but I would like to hear from people who have done this themselves.

A former member of the Bosnian Serb Army has left the U.S. to return to Serbia after a federal judge ordered his denaturalization based on concealment during his application for U.S. citizenship that he served in the military during the Bosnian war.
What is Denaturalization ? Denaturalization is the reverse of naturalization, when a state deprives one of its citizens of his or her citizenship. In January 2010, a civil complaint was filed against Gostic alleging illegal procurement of U.S. citizenship and requesting his denaturalization. Court documents allege that Gostic served in the Zvornik Infantry Brigade of the Bosnian Serb Army from April 1992 until December 1995. According to court documents, international tribunals have found that some units of the Zvornik Brigade engaged in war crimes and crimes against humanity, and that they participated in the July 1995 action against the Srebrenica enclave during which some 8,000 Muslim men and boys were executed.

You do not require valid visa stamp to go India. If your kids are US citizen, you will need PIO card for them. While travelling back from India, you will be asked for valid Visa or AP to board fight for US from Frankfurt.
Our visa stamp (H1B/H4) are expired in our passports. We are planning to travel via 'Frankfurt (FRA), Germany' to Mumbai in Lufthansa airlines and we will get our passport .....................

skarthy: Upgrade your H1 transfer to premium processing, get the transfer approved. Re-enter the country by showing your wife's old H1 stamping, get a new I-94 based on new approved H1 petition at POE. This is a easy route; If I were you, I will do this.
So We are abandoning the current H1 if we go before its approved .
How do I get the I-94 based on the new H1B , just ask them to stamp it like that ?

Did you proceed with your planned visa interview? Any issues? I recieved a simliar call yesterday and my interview is for Sept 13. I am also in my 7th year extension but I had an OWI issue 5 years back and had to wait 45 days in Mexcio the last time I went for stamping.
Please let me know the outcome of your interview so I can prepare accordingly

PD isn't current, but just check i-485 online status, showing "Document production or Oath Ceremony" (i.e., the last cycle).
There was indeed a soft LUD in June this year. After that nothing much else. Is there sth good coming along my way?
Appreciate if anyone here can share his/her thoughts/comments.
Don't rely on online status, take infopass and check it out. BTW, it is most likely a FP notice, not an approval.

Hi All,
I am planning to paper file my wife's EAD renewal and AP for both me and my wife.
Questions:-
1. Can anyone who paper filed recently post information on filing EAD/AP
2. Since my wife filed for I-485 last year and paid $1010 fees,she falls under FEE WAIVER for both EAD and AP-I believe she can renew EAD/AP unlimited till she gets GC?
3. Can someone post what did they do additional for filing as FEE WAIVER?
Any detailed steps on paper filing with FEE WAIVER would be great.

That's outrageous. I'm guessing it has been pending at the TSC. Did you call them? Could you please let us know what their response was?

Hello Friends
I am observing the alerts and discussions here and also the current political activities.Such a pity that we dont mean anything compared to those who broke the law to enter here.
Anyways we are part of this system and have to keep fighting till we go down.
I have a suggestion: Can we make a online petition focussing clearly on just eb provisions in the bill coming to the floor . We can make immigration voice as the sender and send to only senate judiciary committee members .
We should also let them know that our community is closely following senate proceddings and actvities and would request to know their stand on our plight. I dont think those guys know we exist for one or second we r watching them close.Why would they talk of us if they dont know we r watching..
we should ask them for answer:do u want us to leave now as its not possible for a eb3 indian to stay on in one job for years waiting for gc. or do u really want tohelp us out.
i think a single petiition with thousands of signs would be better right now as time is limited. any thoughts..if u guys approve we have to work real fast on it.

I think you cant work internationally and invoke AC21. It doesnt make any sense. However, you can work internationally without invoking AC21 and still keep the GC process alive, because GC is for a future position.

I am also in same situation where my salary is much less than what is mentioned in LC. I am not sure if its going to affect my 485 application. I have got my 140 approved though. I have asked this question to attorneys and forums and everybody has the same opinion that GC is for future job so it should not matter if one's wages are not matching with LC.

You always send 485/140 to the address shown in the form instructions.
Your 485/140 maybe processed by Nebraska/Texas Service centers.

I have a wedding in Canada in January 2011. I would like to know if I need an Advance Parole to Canada then re-enter? Somehow I read somewhere about Canada and Mexico have different requirements.

Yes, you WILL need AP. DO NOT leave without an APPROVED AP in hand, to Canada, as that will make your GC application deemed abandoned. Repeat, you need an APPROVED AP in hand, before you depart for Canada.

I came to know that my 485 wld bet rejected and I wld be receiving all my applications as my employer has sent wrong fee to lawyer...
yesterday when I asked my company people to send the copies of all those checks that they have sent to lawyer and I found the 485 check has $385 on it....actually I just asked them after going through couple of threads related to 485 rejections in murthy.com...and got this bloody news..
I cleary sent mails abt sending $395 to my lawyer and our company has sent 385 it seems...due to the excessive volume of apps received at that time my lawyer office hasn't really checked all those checks it seems...they clubbed those checks with the my application and sent to TSC...and my lawyer informed that i wld get rejection....
can't they understand how sensitive it is?..can't they put their full mind while writing checks?...this is just ridiculous...
i have become victim of someones mistake,,,,,
i'm not saying that it is intentional but can't they be responsible?...
now after all this has happened they r talking abt SORRY stuff,,who cares...

May be you are right. My EAD got approved and waiting for FP.
