    hello,
    I have an EAD and have an approved labor and I-140 approved for over 180 days with my employer.
    I am interested in knowing the clarity on SOC (speciality occupation codes) with AC21.

    My current labor when filed has details in my ETA9089 form as -
    1. SOC - 151051
    2. Job Title - Computer Consultant/Programmer Analyst
    3. Skill Level - II
    4. Wage offered - $76k
    5. Prevailing wage - 60k

    I have a new job offer, from another company whose details are -
    1. Job Title - Managing Consultant
    2. Wage offered - $120k
    This job would require me to play a role of Manager/Supervisor, Architect and also code.

    Im not sure what SOC code the new company would offer me? From the latest bls.gov SOC guide "Supervisors of workers in Major Groups 13-0000 through 29-0000 usually have work experience and perform activities similar to those of the workers they supervise, and
    therefore are classified with the workers they supervise."

    So besides similar job duties does it require SOC compatibility for AC21?

    Dear All,

    i might have posted this query in some other forums too, but could not get much response and hence reposting. Please pardon me if you happen to re-read this.

    1) I got my fresh H1B visa stamp from employer A and started workin with him from 1st October 2007 . Visa was valid from August 2007 to August 2010.

    2) Was laid off on 16th November 2007.

    3) Found another employer B and he applied for H1B transfer on 21st December 2007 using regular processing.

    4) I do not have any pay stup or any kind of information from employer B.

    5) I found another employer (C) and he applied for H1B with a receipt date 19th March 2008 using premium processing.

    6) Got approval (I797B) on 21st march 2008. Attorney from employer C told me that i need to leave the US and come back and can start working with employer C. I went to Mexico and came back and started working with employer C since 1st April 2008.


    7) Got the job with employer D. Employer D filled for H1B transfer. This time i got approval (I797A) with I-94 attached. Started working with employer D since 1st October 2008.

    8) I am still employed with employer D. But my visa is going to expire in August 2010. My I-94 (came with I-797A) is valid till October 2011.

    9) I want to get a new visa stamp in my passport and hence want to visit New Delhi US embassy.

    Will i be having problem on visa stamping because i dont have pay stup from 16th Nov 2007 till 1st April 2008 ( 4 months and 16 days = 136 days)?

    Hi,


    I applied I-485,EAD,Advance Parole on July 20,2007 but i have not yet received any receipt number as of now.

    During that time I could not able to apply for my wife. She will be coming to USA on H4 visa in the mid of October.

    what are the possibilities to include her in my greencard process?

    Please educate me on this situation to take care of my wife's greencard process with my GC process and also please share your experiances if some one has similar kind of situation.

    My Case Details

    Labour Filed (Perm)--------------------------> Jan-2006
    Labour Approved -----------------------------> April-2006
    I-140 Filed -----------------------------------> Aug-2006
    I-140 Approved --------------------------------> November 2006
    I-485 applied only for myself --------------> July 20,2007
    First entry into USA------------------------>January 2000
    H1 valid till ------------------------------>January 2010(with 3 years extension from 2007 to 2010)

    The other day had a friend at my place and I felt like throwing him out of my house. These guys are crying by their asses days and night. Believe me he is the guys whose wife drives him to work because his DL expired and PA DOT is not issuing him License because he has less than 1 year visa. But he was talking this government, that government..... I asked him to keep quiet and watch, if we are successful you'll get a free ride, if not then keep crying through your ass, you're doing it anyway!!!!

    My AP document expired in NOv 2008. I traveled to India and got back in Aug 2008. The officer stamped the document and wrote paroled until Aug 2009.
    Can I travel on this document?
    Please advise.

    I'm currently working for Company A on H1B Visa. My GC is sponsored through Company B as a future employee. I never worked for Company B which has sponsored for my GC. I have applied for I485 and I140 has been approved for more than 6 months.

    Company A is going through lay offs and wont be able to apply for my GC. My 6 yr limit on H1B from Company A will expire next year.

    Can i apply for H1B extension through Company A based on my I-140 from Company B.

    Yes, it is legal, allowed, and possible

    no. Comp A cannot apply for H1 extension as the PERM labor is not held by them. What you can do is get an EAD and continue to work for Company A, but then Company A will have to take over the process using AC21

    My date will be current from September 1st. Is it okay to travel to India on a short trip while the date is current? If 485 gets approved while I am india, can I still come back on advance parole?

    One of my friends did this his green card was approved while he was away, he did not face any issues in returning or converting to GC later.

    I have another cpl. of questions:
    - After e-filing I was notified that the case has gone to National benefit center. Is this common/okay?
    - Secondly, I am confused what to explain for Part 7 of I-131 form that states : "On a seperate sheet of paper, Explain how you qualify for an advance parole document and what circumstances warrant issuance of advance parole"

    I think it means if you sent in your application then you can get a receipt by the date listed.
    Atleast thats the interpretation I got from it.

    hi,
    i have a question whether to use EAD or H1B? Initiallly i re-entered into usa after finishing my first 6yr term of H1B in June 05 on H1b. Later changed employer. New employer filed my GC using existing labor (EB3) in 2006 and also filed for i-140 & i-485 in oct 2007. so the transferred h1b is expiring on 06/2009. my ead expired in Oct 2008. I am thinking of renewing EAD than H1b which i am planning to file in this month (Feb, 2009).

    questions:
    1. If i go back to India in Mar 09 - Can I come back using EAD (Once its approved and someone sends my EAD & AP to India) as i haven't used EAD?
    2. my transfered H1b is expiring on Jun 09 and i don't want to go to Madras to stamp the transfered company's visa on my passport as i doubt to get it - the Consulate might ask me so many questions when its expiring in june why you want to go to usa for 3 or 4 months.
    3. The best bet - do i need to wait for my renewal of EAD & AP and then leave?

    Please let me know as my travel plans are dependent on this.

    By amendent, you mean we should send a letter with the additional document after we get the receipt? Will USCIS be able to match this additional document with the original file?

    Has anybody done this before? Is there any official regulation on amendent?

    Hi,

    I am currently working on a fulltime H1B and my GC process is going on with second stage (I140) in progress. Now my old employer wants me to work parttime for them which I agreed upon but this is a possibility only if I have a parttime H1B applied w.r.t old employer which I am thinking to apply for it and work parttime. But my question here is does this effect my GC processing? If it is what are the effects? Please reply me back. Thanks a lot.

    According to an attorney, you must work part time 35 hrs per week in order to keep your GC process going on.

    Last year i filled AR-11 manually and mailed with 39 cents to USCIS . Even though My Approval papers went to old address and then went back to USCIS. Later on I called them and gave the new Address then only they sent again to New Address . I don't think USCIS will see our AR-11 forms .
    I don't know abt online AR-11 Form , it came recently .

    My visa is H4 and I got my EAD last month, but my family's I-140 and I-485 on pending, if I use my EAD , unfortunately I-140 we can not pass, is that means I must leave U.S.A. in ten days?
